1. Acceptance of Terms

Welcome to FishReading (小鱼阅读)! Please read these Terms of Service carefully before using this application. By using this app, you agree to be bound by all provisions of these terms. If you do not agree to these terms, please do not use this app.

2. Service Description

FishReading is an e-book reading application that supports multiple formats including EPUB and PDF. It provides reading management, dictionary lookup, note-taking, reading statistics, and other features to help users enjoy a better reading experience.

3. User Responsibilities

3.1 Book Management

  • This software is only responsible for managing and reading the books you import. It does not provide cloud backup services
  • You are responsible for maintaining your own backup copies of book files to prevent data loss
  • We are not liable for any book loss due to device failure, app uninstallation, system upgrades, or other reasons

3.2 Notes and Book Association

  • Notes you create while reading are tightly associated with their corresponding books
  • Once a book is deleted, related notes cannot be viewed within the original book context and can only be viewed as plain text
  • Please backup your notes before deleting any books

3.3 Content Legality

  • You must ensure that all imported books are legally obtained through legitimate channels
  • Do not import, store, or distribute pirated, infringing, or illegal content
  • You bear full legal responsibility for the legality of imported content
  • We reserve the right to terminate your access if illegal content is discovered

3.4 Content Sharing

  • Content analyzed, excerpted, or shared through this app must comply with local laws and regulations, including but not limited to:
    • Copyright laws
    • Social media sharing regulations
    • Personal information protection laws
    • Cybersecurity laws
  • You are solely responsible for any legal disputes arising from shared content

3.5 Minor Users

  • Users under 18 years of age must obtain guardian consent before using this app
  • Guardians should supervise minor users' behavior to ensure compliance with applicable laws
  • Guardians are responsible for supervising minors' use of this app

3.6 Code of Conduct

  • Prohibited from using this app for any illegal activities
  • Prohibited from attempting to crack, attack, decompile, or otherwise interfere with normal app operation
  • Prohibited from exploiting app vulnerabilities for improper gains
  • Prohibited from spreading viruses, malicious code, or other harmful programs
  • Users who violate these rules may have their access immediately terminated

4. Account and Security

4.1 Account Management (if applicable)

  • You are responsible for safeguarding your account and password, and for all activities under your account
  • Accounts are for personal use only. Do not transfer, lend, rent, or share your account
  • If you discover unauthorized access or security concerns, contact us immediately and change your password
  • You bear responsibility for losses resulting from failure to properly secure your account

4.2 Account Deletion

  • You may request account deletion at any time through "Settings → Account Management"
  • Upon deletion, all account-related data will be permanently erased and cannot be recovered
  • Please export or backup important data before deletion

5. Data and Privacy

5.1 Local Storage

  • All your data (books, notes, reading records, bookmarks, highlights, settings, etc.) is stored locally on your device
  • We do not sync your reading data or note content to cloud servers
  • Data security and integrity depend on your device security settings (device passcode, biometric authentication, Find My iPhone, etc.)
  • You should take appropriate measures to protect your device and data

5.2 Nature and Scope of Data Collection

Data We May Collect:

  • Usage Data:

    • Feature usage frequency (e.g., reading sessions, word lookups)
    • Page visit records (e.g., settings page visits)
    • Crash logs (containing stack traces, not user content)
    • Performance data (startup time, page load speed)
    • Error logs

  • Device Information:

    • OS version (e.g., iOS 17.0)
    • Device model (e.g., iPhone 14 Pro)
    • Screen size and resolution
    • App version number
    • Device identifiers (IDFA, only with your authorization)
    • System language settings

  • Anonymous Statistics:

    • User activity (DAU, MAU)
    • Reading duration statistics (not specific content)
    • Book format distribution (EPUB/PDF ratio)
    • Feature usage preferences

We Explicitly Do NOT Collect:

  • ❌ Your book file content or titles
  • ❌ Your detailed note content or excerpts
  • ❌ Personally identifiable information (real name, ID numbers, home address, phone numbers)
  • ❌ Your specific reading positions and progress
  • ❌ Your search or word lookup history specifics
  • ❌ Contacts, photos, location, or other sensitive data

Data Usage:

  • Improve app user experience and stability
  • Fix bugs and technical issues
  • Develop new features and optimize existing ones
  • Generate anonymous usage statistics
  • Send app update notifications (with your permission)

User Control:

  • You can choose whether to allow data collection in "Settings → Privacy → Data Collection"
  • You can disable ad tracking in iOS Settings: Settings → Privacy & Security → Tracking → Disable "Allow Apps to Request to Track"
  • Disabling data collection does not affect core reading functionality

5.3 Third-Party Services

This app may integrate the following third-party services that may collect and process your data:

Data Sharing Statement:

  • We will not proactively share your data with third parties
  • Except when: legally required, requested by government authorities, or necessary to protect our legitimate interests
  • In the event of company merger, acquisition, or asset sale, your data may be transferred as an asset. We will notify you in advance.

5.4 Data Security

  • We employ reasonable technical and administrative measures to protect your data
  • Including but not limited to: encrypted data transmission, access control, security audits
  • However, due to inherent network risks, we cannot guarantee 100% data security
  • In case of data breach, we will:
    • Immediately take remedial measures
    • Notify affected users within legally required timeframes
    • Cooperate with regulatory investigations

5.5 Data Retention

  • Local data remains on your device until you uninstall the app
  • Analytics data such as crash logs are retained for no more than 12 months
  • After account deletion, related data is permanently erased within 30 days

5.6 Children's Privacy

  • This app does not knowingly collect personal information from children under 13
  • If we discover we have collected children's information without parental consent, we will delete it immediately
  • Parents who discover unauthorized app use by minors should contact us

6. In-App Purchases and Subscriptions (if applicable)

6.1 Paid Services

  • The app may offer:
    • Subscription services (monthly/annual)
    • Permanent feature unlocks
    • Ad removal
  • All prices are as displayed in the app and may vary by region and exchange rates
  • Payment takes effect immediately with no cooling-off period or unconditional refund rights
  • Promotional prices are valid only during the promotion period

6.2 Auto-Renewal Subscriptions

  • Subscriptions automatically renew 24 hours before expiration and charge your Apple account
  • Renewal charges are collected within 24 hours before the current period ends
  • You can manage subscriptions or disable auto-renewal in iOS Settings:
    Settings → [Your Name] → Subscriptions → FishReading → Cancel Subscription
  • After disabling auto-renewal, the subscription expires at the end of the current period
  • Canceling auto-renewal during the current period does not refund already paid fees

6.3 Free Trials (if applicable)

  • First-time subscribers may enjoy a free trial period
  • Trials automatically convert to paid subscriptions after expiration
  • To avoid charges, cancel at least 24 hours before trial expiration
  • Each user or device is eligible for only one free trial

6.4 Refund Policy

  • In-app purchases follow Apple App Store refund policies
  • To request a refund:
  • Apple determines refund eligibility; we cannot process refunds directly
  • We reserve the right to address:
    • Malicious refunds (fraudulent claims after using services)
    • Abuse of refund policies
    • Such behavior may result in account suspension

6.5 Price Adjustments

  • We reserve the right to adjust pricing for paid services at any time
  • Price changes do not affect current subscription periods for existing paid users
  • Subscribers will be charged the new price upon renewal
  • Significant price changes will be communicated in advance

6.6 Service Termination Impact on Paid Users

  • If we terminate a paid service, we will provide at least 30 days' notice
  • Paid users can continue using the service until the end of their subscription period
  • Refund matters due to service termination will be handled case-by-case

7. Intellectual Property

7.1 App Copyright

  • All source code, design, UI, trademarks, icons, and documentation of FishReading are owned by the developer
  • This app is protected by copyright law, trademark law, and other intellectual property laws
  • Without written permission, you may not:
    • Copy, modify, or adapt any part of the app
    • Decompile, reverse engineer, or disassemble the app
    • Create derivative works or competing products
    • Remove or modify any copyright notices, trademarks, or other proprietary notices

7.2 User Content

  • You or the original rights holders own the intellectual property of books you import and notes you create
  • You grant this app permission to manage, display, and process this content on your device
  • This app claims no rights to your content
  • You must ensure you have the right to upload and use such content

7.3 Trademark Use

  • "FishReading (小鱼阅读)", the app icon, and related marks are trademarks of the developer (if applicable)
  • Unauthorized commercial use of these trademarks is prohibited
  • Use of confusingly similar trademarks, names, or identifiers is prohibited

7.4 Intellectual Property Complaints

  • If you believe app content infringes your intellectual property rights, please contact us via the methods in "Contact Us"
  • Please provide:
    • Your identity verification
    • Proof of rights
    • Detailed description of the infringement
    • Contact information
  • We will investigate and respond to valid complaints promptly (typically within 5 business days)

8. Disclaimers

8.1 Service Quality

  • This software is provided on an "AS IS" and "AS AVAILABLE" basis
  • Without any express or implied warranties, including but not limited to:
    • Merchantability
    • Fitness for a particular purpose
    • Non-infringement
    • Error-free or uninterrupted service
    • Accuracy or reliability of data
  • We strive to provide stable services but are not liable for losses caused by software defects, bugs, compatibility issues, or server failures

8.2 Translation and Dictionary

  • Translation, dictionary lookup, and vocabulary features provided by this app are for reference only
  • No guarantee of accuracy, completeness, timeliness, or applicability
  • These features rely on third-party data sources or algorithms beyond our complete control
  • We are not responsible for misunderstandings, learning errors, exam mistakes, or any losses resulting from reliance on these features
  • For critical content (legal documents, medical records, academic papers, business contracts), please consult authoritative dictionaries or professional translators

8.3 Data Loss Disclaimer

We are not responsible for data loss, corruption, or inaccessibility due to:

  • Device failure, damage, theft, loss, or water damage
  • OS upgrades, downgrades, resets, or firmware updates
  • App uninstallation, update failures, installation errors, or accidental deletion
  • User errors, intentional deletion, or improper use
  • Viruses, malware, hacking, or phishing attacks
  • Insufficient storage space causing data truncation
  • Battery depletion causing data corruption
  • iCloud backup or restore failures
  • Data migration failures between devices
  • Force majeure events (natural disasters, war, pandemics, terrorism, government actions, network outages, power failures, etc.)

⚠️ We strongly recommend regularly backing up important data via iTunes, iCloud, or other methods!

8.4 Third-Party Services

  • Dictionary definitions, translations, etc. come from third-party data sources
  • Ad content is provided by third-party advertising platforms
  • We are not responsible for the accuracy, legality, or security of third-party content
  • If third-party services are interrupted, changed, or terminated, related features may be affected or disabled
  • Disputes with third-party service providers should be resolved directly with them

8.5 Network Services

  • Some features (dictionary lookup, login verification) require network connection
  • We are not responsible for network connection quality, stability, or availability
  • We are not liable for feature malfunctions due to network interruptions or slow speeds

8.6 Device Compatibility

  • We strive to support mainstream iOS devices and versions
  • However, we do not guarantee perfect operation on all device models and iOS versions
  • Older or newer system versions may have compatibility issues
  • Jailbroken devices may cause malfunctions; we do not provide technical support for them

8.7 Limitation of Liability

  • To the maximum extent permitted by law, we are not liable for any losses resulting from your use of this app
  • Under any circumstances, our liability is limited to the total fees you paid us in the past 12 months
  • For free users, the liability limit is CNY 100 (approximately USD 15)
  • We are not liable for the following losses (even if advised of their possibility):
    • Loss of profits, business opportunities, or data
    • Indirect, incidental, special, punitive, or consequential damages
    • Decision-making errors due to reliance on app content
    • Any losses due to service interruptions

9. Service Changes and Termination

9.1 Service Changes

  • We reserve the right to modify, suspend, or terminate part or all of the services at any time without prior notice
  • However, we will strive to:
    • Provide 30 days' notice for major feature changes or pricing model adjustments via in-app notifications
    • Announce overall service termination 60 days in advance
  • We have the right to:
    • Add, remove, or modify app features
    • Change free/paid feature designations
    • Alter technical architecture or service models

9.2 User-Initiated Termination

  • You may stop using and uninstall the app at any time
  • Please backup important data before uninstallation

9.3 Termination by Us

We may terminate services to you in the following circumstances:

  • Violation of these terms or applicable laws and regulations
  • Engaging in activities that compromise app security or harm other users
  • Extended inactivity (no login for more than 24 months)
  • Providing false information or malicious registration
  • Overall app shutdown
  • Other circumstances we deem necessary

After termination:

  • Your access rights will be immediately revoked
  • Your local data on the device will not be automatically deleted, but we will no longer provide technical support
  • Account data (if any) will be deleted
  • Unused paid services will not be refunded (in cases of malicious violations)

9.4 Terms Updates

  • These terms may be updated from time to time to reflect legal changes or service adjustments
  • Updated terms will be published within the app with user prompts on launch (for major updates)
  • Updates will indicate the update date and main changes
  • Continued use of the app indicates acceptance of updated terms
  • If you do not accept updated terms, please immediately stop using and uninstall the app

10. Export Control and Compliance

10.1 Export Restrictions

  • This app and related technology may be subject to export control laws of China and other countries
  • You may not export, re-export, or transfer the app to restricted countries or regions
  • You may not provide the app to sanctioned individuals or entities
  • You agree to comply with all applicable export control laws and regulations

10.2 Geographic Restrictions

  • This app may be unavailable or have limited features in certain countries or regions
  • We reserve the right to restrict access from specific regions
  • You may not use VPN or other technical means to circumvent geographic restrictions

10.3 Compliance

  • Your use of this app must comply with all laws and regulations in your jurisdiction
  • Including but not limited to copyright law, cybersecurity law, personal information protection law, anti-terrorism laws, etc.

11. Miscellaneous Provisions

11.1 Entire Agreement

  • These terms, together with the app's Privacy Policy and User Guide, constitute the complete agreement between you and us regarding use of this app
  • These terms supersede all prior oral or written agreements, promises, representations, or understandings

11.2 Severability

  • If any provision of these terms is held invalid, illegal, or unenforceable by a court or arbitration body
  • That provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable
  • If modification is not possible, that provision shall be severed
  • All remaining provisions shall remain in full force and effect

11.3 Waiver

  • Our failure to exercise or delay in exercising any right under these terms does not constitute a waiver
  • Single or partial exercise of a right does not preclude further exercise or exercise of other rights
  • Waiver of a breach does not constitute waiver of future breaches or other provisions

11.4 Assignment

  • You may not assign your rights or obligations under these terms without our prior written consent
  • Any unauthorized assignment is void
  • We may assign our rights and obligations to affiliates, successors, or assigns without your consent
  • In case of merger, acquisition, or asset sale, these terms automatically transfer to the successor

11.5 Headings

  • Section headings are for convenience only and do not affect interpretation
  • Headings should not be relied upon when interpreting these terms

11.6 Language Versions

  • These terms are provided in both Chinese and English
  • Both versions have equal legal effect
  • In case of conflict or ambiguity, the Chinese version shall prevail

11.7 Independence

  • No partnership, agency, employment, or other special relationship exists between you and us
  • These terms do not grant any third party any rights or benefits

11.8 Notices

  • We may send you notices via:
    • In-app push notifications
    • In-app announcements
    • Registered email
  • Notices are deemed delivered upon sending

11.9 Effective Date

  • These terms take effect when you first use this app
  • Updated terms take effect on the publication date or the effective date specified

12. Dispute Resolution

12.1 Governing Law

  • The formation, effectiveness, interpretation, performance, modification, and termination of these terms, as well as dispute resolution, shall be governed by the laws of the People's Republic of China (excluding conflict of law rules)
  • If mandatory laws in your jurisdiction conflict with these terms, these terms shall prevail to the maximum extent permitted by law

12.2 Negotiation

  • Any disputes, controversies, or claims arising from these terms or app usage shall first be resolved through friendly negotiation between the parties
  • Negotiation period: 30 days

12.3 Arbitration or Litigation

  • If negotiation fails, either party may choose:
    • File a lawsuit with a competent People's Court at the developer's location (preferred method)
    • Submit to arbitration by the China International Economic and Trade Arbitration Commission under its rules
  • Arbitration awards are final and binding on both parties

12.4 Jurisdiction

  • If litigation is chosen, both parties agree to submit disputes to the People's Court at the developer's location
  • And waive the right to sue in other courts of competent jurisdiction

12.5 Cost Allocation

  • Costs incurred during dispute resolution (attorney fees, court fees, travel expenses, etc.) shall be borne by the losing party
  • In case of partial loss, allocation is determined by the court or arbitration body based on proportionate responsibility
